1. Who we are
This website and online store are operated by Iryna Havuka (operating as “Ira Havuka”). In these Terms of Service (the “Terms”), “we”, “us”, and “our” mean Ira Havuka. By visiting our site and/or purchasing from us, you agree to be bound by these Terms and by any policies we link to, including our Privacy Policy and Return & Refund Policy.
Our store runs on Shopify Inc., which provides the e-commerce platform we use to sell our products and services.
2. Eligibility
You must be the age of majority where you live, or have a parent/guardian’s consent for any minor who uses the site. You may not use the site for any illegal or unauthorized purpose.
3. Your account and accuracy of information
Keep your account, billing, and shipping information current and accurate. We may refuse, limit, or cancel any order (for example, suspected fraud, duplicate orders, or unusual quantities). If we change or cancel an order, we’ll try to notify you using the email, phone, or billing address you provided.
4. Products: originals, prints, framing, made-to-order
Many fine-art prints are made-to-order. Product descriptions, dimensions, borders, paper types, and production lead times are shown on each product page. Colour appearance can vary between screens and real life. Minor variations in trim, borders, paper texture, or finish may occur and are not defects.
We may limit sales by person, region, or order; change product descriptions or pricing; or discontinue items at any time.
5. Pricing, currency, taxes, duties, and shipping
All prices are listed in CAD unless stated otherwise and may change without notice. Applicable Canadian sales taxes (for example, GST/HST/PST) are added at checkout based on your delivery address.
International shipments may be subject to customs, import duties, VAT, or brokerage fees charged by your country upon arrival. These charges are your responsibility. Shipping options, costs, and estimated timelines appear at checkout and/or on our Shipping page. Timelines are estimates and can be affected by carriers, customs, or events outside our control.
6. Payment and security
We accept the payment methods shown at checkout and process payments through Shopify Payments and/or third-party processors. Your payment information is encrypted during transmission. You are responsible for any fees charged by your card issuer or bank.
7. Order confirmation, production, delivery, and risk of loss
After you place an order, you’ll receive an email confirmation. For made-to-order items, production starts shortly after payment. We’ll send tracking details when available. Risk of loss passes to you when the carrier takes possession. If a parcel arrives damaged, contact us within 7 days of delivery with your order number and photos so we can help.
8. Returns, exchanges, and cancellations
Please review our Return & Refund Policy. Because many items are made-to-order, cancellations are usually not possible once production has begun. If we made an error or your item arrived damaged, we will make it right according to our policy. To start a request, email us at hello@irahavuka.ca.
9. Intellectual property
All artworks, images, product photos, videos, designs, text, and other content on this site are protected by copyright and other laws. We reserve all rights. Buying an original or a print does not grant you any commercial or intellectual-property rights in the artwork. You may not reproduce our content without our prior written permission, except as allowed by law.
10. User content and feedback
If you submit reviews, photos, comments, or other materials, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display that content for our business purposes in line with our Privacy Policy. Do not submit unlawful, infringing, or harmful content. We may remove content at our discretion.
11. Third-party tools and links
We may provide access to tools or websites operated by others. We do not control and are not responsible for those sites, tools, content, or policies. Use them at your own risk and review their terms and privacy notices.
12. Prohibited uses
You agree not to use the site or our content to: break the law; infringe intellectual-property rights; harass or discriminate; transmit malware; scrape or collect others’ personal data; misrepresent your identity; or bypass security or access controls.
13. Warranties and your legal rights
The site and our products are provided “as is” and “as available.” We do not guarantee that the site will be uninterrupted, timely, secure, or error-free. To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. Nothing in these Terms limits your non-excludable statutory rights under applicable Canadian consumer-protection laws.
14. Limitation of liability
To the extent permitted by law, we and our directors, officers, employees, agents, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or use, arising from or related to your use of the site or any purchase. Where liability cannot be excluded, it is limited to the amount you paid for the product that gave rise to the claim.
15. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the site.
16. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, strikes, carrier delays, or supply disruptions.
17. Changes to the site, products, or Terms
We may update products, pricing, and policies (including these Terms) at any time by posting on the site. The version posted when you place an order applies to that order. If you continue using the site after changes, you accept the updated terms.
18. Governing law and venue
These Terms and related policies are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there. The courts of British Columbia will have exclusive jurisdiction over any dispute, except where prohibited by law. If any part of these Terms is unenforceable, the rest remains in effect.
19. Entire agreement and no waiver
These Terms, together with our linked policies, are the entire agreement between you and us about this site and your purchases. Our failure to enforce a right is not a waiver.
